Design and build contracts
We advise employers and contractors on the negotiation and drafting of design and build contracts. We can help you select the most suitable JCT contract for your project, and amend and add to it, depending on your specific requirements. We also prepare all of the necessary documents that need to be issued as your project takes shape. For example, collateral warranties, change orders and vesting certificates.

Professional appointments
We prepare the contracts for your project team members, including architects, structural engineers, planning and building control consultants, cost consultants, principal designers and employer’s agents. We tailor each contract so that it reflects your requirements in area, such as insurance, intellectual property rights, assignability, compliance with project documents, and third party rights or the provision of collateral warranties for funders, tenants or project purchasers.

Project finance
We represent borrowers and lenders in secured and unsecured project finance arrangements. We are frequently called upon to advise on, draft and negotiate facility agreements, intercreditor deeds of priority and subordination, as well as related security arrangements, including personal guarantees, debentures, legal charges and mortgages. If applicable, we also arrange for appropriate collateral warranties to be supplied by the principal contractor and any sub-contractors, if required by the lender.

Disputes can apply to a range of areas, including delays, non-payment, contract breaches and work quality. We can advise you on the dispute process that needs to be followed in accordance with the underlying contractual documents. We can also explore the option of going down the route of early stage mediation and arbitration with you, which would enable you to avoid having to pay escalating litigation costs.

Plot sales
We provide cost effective legal support for the sale of units. Our team prepares standard leases and contract packs, providing prospective purchasers with all of the title and other information they need to receive as part of the standard conveyancing process.
